Syria Abolishes Terrorism Cases Court and Begins Addressing the Impact of Tens of Thousands of Lawsuits

Damascus – VOS

The Syrian Ministry of Justice announced the start of a new phase in addressing the legal consequences resulting from the work of the Terrorism Cases Court, after the People’s Assembly approved a draft law abolishing the court and nullifying the effects of the rulings and decisions it issued.

The ministry said on Sunday, September 20, 2026, that the Supreme Judicial Council had formed, since April 17, 2025, specialized judicial committees to review the files linked to the court and address the legal and exceptional measures resulting from it.

According to data from the Ministry of Justice, the review work covered 49,726 lawsuits, and a number of exceptional measures have so far been lifted, including travel bans and asset freezes, in 38,566 lawsuits.

The ministry added that the procedures also included lifting measures in investigation departments against 56,726 persons, while the Public Prosecutor’s Office received 5,255 urgent requests to address cases related to previous rulings and restrictions.

According to the ministry, the total number of persons whose measures and restrictions related to these files have been lifted reached about 130,000 persons.

Removal of Seizure and Legal Restrictions

The Ministry of Justice clarified that the names of the persons whose situations have been addressed were referred to the precautionary seizure system with the aim of removing the restrictions imposed on them, while coordination continues with the Ministries of Interior and Finance to complete the executive effects of the decisions.

The procedures, according to the ministry’s statement, are not limited to the rulings issued by the Terrorism Cases Court, but extend to studying the effects of other exceptional rulings and measures, including some judgments issued by field and military courts, in addition to emergency and in absentia rulings.

The ministry also said it is working on opening legal avenues for those affected to file lawsuits regarding the damages they suffered, in parallel with examining accountability for those responsible for violations linked to exceptional trials.

Law Approved by the People’s Assembly

The Syrian People’s Assembly had unanimously approved, on September 16, 2026, the draft law abolishing the Terrorism Cases Court and nullifying the effects of the rulings issued by it.

The draft, as announced during its discussion, assigns the task of addressing the legal and material consequences of those rulings to the Supreme Judicial Council, including files related to confiscated properties and the legal and security restrictions resulting from the court’s decisions.

Previous official data indicate that the broader file linked to the rulings and procedures of the Terrorism Court includes more than 90,000 cases, while the latest statement of the Ministry of Justice more specifically addressed 49,726 lawsuits that were subject to direct judicial procedures and reviews.

Legal Legacy Dating Back to 2012

The Terrorism Cases Court was established in 2012 under Law No. 22, during the rule of former President Bashar al-Assad, and was tasked with examining the cases referred to it under anti-terrorism legislation.

Throughout its years of operation, the court faced widespread criticism from Syrian and international human rights organizations due to the nature of the procedures followed before it, and the connection of many of its rulings to political cases, protests, and opponents of the former regime.

With the abolition of the court, the focus now shifts from abolishing the judicial institution itself to how to implement the decision in practice, particularly the restitution of confiscated properties, lifting of seizures and restrictions, and settling the legal status of those affected by its rulings.

The Ministry of Justice affirms that work will continue until the legislative and executive framework for abolishing the court and addressing the consequences resulting from its rulings and decisions is completed.
